What happens if support is refused

If section 95 or section 4 support is refused or withdrawn, there will usually be a right of appeal against this decision. If there is no right of appeal, the person would need to seek legal advice about whether there are grounds for a judicial review.

If section 98 emergency support is refused there is no right of appeal. Instead, a reconsideration can be requested from the Home Office and legal advice may need to be sought. There is more information on the Asylum Support Appeals project's section 98 factsheet.
