In Scotland, legal aid is funded by the Scottish Government to help people on a low income access legal advice and representation.

Legal aid is not classed as a public fund for immigration purposes. This means it can be accessed regardless of a person's immigration status, including where they have no recourse to public funds (NRPF).

Legal aid services can only be provided by a solicitor. They may be available for a range of legal matters, including:

  • immigration, nationality and asylum
  • housing
  • debt and welfare benefits
  • children's law

Unlike in England and Wales, legal aid in Scotland is available for most immigration matters. This means people on a low income can often get legal advice and representation for immigration applications and appeals.
