How to apply

This information only applies to applications for schedule 10 support that are made on human rights grounds by a person on immigration bail who is living in the community or who is applying for immigration bail from immigration detention.  

Support application

An application for schedule 10 support must be made using form BAIL 409, which is available on gov.uk.

The BAIL 409 form can be used when a person is:

  • Living in the community and needs to be provided with accommodation to avoid a breach of their human rights (and is therefore requesting that their immigration bail conditions are changed to include a residence condition)
  • Applying for immigration bail from immigration detention and needs to be provided with accommodation to avoid a breach of their human rights

The BAIL 409 form can be submitted directly to a Home Office address specified on the form, or to the Home Office through Migrant Help.

Where to get help with an application

Migrant Help are unable to advise and assist with applications for schedule 10 support. A person may be able to get assistance with making an application from a voluntary and community sector organisation that helps people seeking asylum and other migrants

Bail for Immigration Detainees can provide legal advice to people in immigration detention. 

If a person thinks that they meet the requirements for schedule 10 support but they have not been issued with a BAIL 201 notice by the Home Office then they would need to get legal advice from an immigration adviser about the implications of applying for schedule 10 support before they submit an application.
